Terms of service
Last updated: 23 October 2026
These are the terms on which Telos designs, builds, hosts and looks after websites. We have kept them in plain language on purpose — if anything here is unclear, ask us before you sign off a quote.
1. What we do
Telos provides website design and development, website redesign, and website hosting and maintenance. The exact scope of any project is whatever is written in the quote you accept. Anything not in that quote is not included, though we are always happy to price it separately.
2. Quotes and pricing
Websites are sold as monthly plans with no build fee: Start, R399 per month; Grow, R599 per month; and Lead, R899 per month. Each plan can also be paid for a year in one go, for ten months' price: R3 990, R5 990 or R8 990. Each plan includes the design, hosting and the changes described on our pricing page. SEO is from R3 500 per month. Hosting alone, for a site we built, is R99 per month after its first 12 months. Work outside the plans is quoted separately, and that quote is the one that counts.
A quote is valid for 30 days and is based on the scope we discussed. If the scope changes — more pages, new features, a different direction after work has begun — we will tell you what it means for the price and the timeline before we carry on. All prices are in South African Rand.
3. Payment
Monthly plans are billed monthly in advance, from the day your site goes live. We design your homepage first; you pay nothing until you are happy with it. For work quoted separately, unless the quote says otherwise, we ask for a 50% deposit before work starts, with the balance due when the work is done.
Invoices are due within 7 days. If an account falls significantly overdue we may pause work or suspend a hosted site, but we will always contact you first and give you a chance to sort it out.
4. Your part
Projects run late far more often because of missing content than because of development. To keep things moving, you agree to:
- give us the text, images and logo we need, in reasonable time;
- make sure you actually have the right to use everything you send us — photographs, fonts, logos and copy;
- give feedback and sign-off within a reasonable period;
- keep your own account credentials secure.
You are responsible for the accuracy and legality of the content you supply, and you indemnify us against claims arising from it.
5. Hosting and care
Where you take hosting from us, we provide reliable hosting with SSL and daily backups, plus the updates and monitoring described in your plan.
We aim for continuous availability but do not guarantee uninterrupted service. Hosting depends on infrastructure we do not own, and there will occasionally be maintenance windows. We will give notice of planned maintenance where we can.
You may not use hosting we provide for anything unlawful, for spam, or for material that infringes someone else's rights. We may suspend a site that does, and we will tell you why.
Monthly website plans run for a minimum of 12 months from the day the site goes live, then month to month. After the minimum, either of us may end the plan with one calendar month's notice. Hosting alone is month to month with the same notice. If you leave, we will give you a copy of your site.
6. Who owns what
Content you supply — your words, your images, your logo, your brand — stays yours throughout.
On a monthly plan, the design and code we produced specifically for your website become yours once you have paid the 12-month minimum, or the leaving fee if you leave sooner. On a year paid in one go, they become yours once that payment is made. For work quoted separately, they become yours once it has been paid in full. Until then they remain ours.
This does not cover the underlying tools, frameworks, libraries and internal components we reuse across projects; those remain ours, and you get a licence to use them as part of your site. Third-party assets such as stock images or licensed fonts stay subject to their own licences.
Unless you ask us not to, we may show your website in our portfolio and refer to you as a client.
7. Ending things
You can end a monthly plan before its 12-month minimum. If you do, you pay a leaving fee of half of the remaining months of the minimum. For example, leaving the Grow plan (R599 per month) after four months leaves eight months, so the leaving fee is R2 396. There is no leaving fee after the minimum.
A year paid in one go has no leaving fee. It is discounted because it is paid in advance, so it is not refunded if you stop using the site before the year is up.
You can cancel separately quoted work at any time. If you do, you pay for the work completed up to that point, and the deposit is not refundable — it covers the time already committed.
We may end an engagement if an account stays unpaid, if the working relationship becomes unworkable, or if we are asked to do something unlawful. If we end it for any other reason, we will refund whatever you have paid for work not yet done.
8. Liability
We do this work carefully and we stand behind it. But to be clear about the limits: our services are provided as they are, and to the extent the law allows, our total liability for any claim is limited to the amount you have paid us for the work the claim relates to.
We are not liable for indirect or consequential loss, including lost profit or lost business, or for problems caused by third-party services, by content you supplied, or by changes you or someone else makes to a site after we hand it over.
Nothing here limits liability that cannot lawfully be limited, including under the Consumer Protection Act.
9. Governing law
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. If part of these terms turns out to be unenforceable, the rest still stands.
10. Changes
We may update these terms. The version that applies to your project is the one in force when you accepted your quote. Continued use of hosting after a change means you accept the updated terms.
